Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between you and Gonzalo Gutierrez Moreno, a sole proprietor registered in Argentina (“RePhoto”, “we”, “us”, or “our”). By accessing or using our website at rephoto.app and related services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you have the legal capacity to enter into this agreement and, if you are using the Service on behalf of an organization, that you have the authority to bind that organization to these Terms.

2. Accounts

To access certain features, you may need to create an account or sign in using an identity provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@rephoto.app if you suspect unauthorized use.

3. Acceptable use

By uploading a photo to the Service, you represent and warrant that you own the photo or have obtained all necessary rights, licenses, and permissions to upload it and to grant us the rights described in these Terms. You are solely responsible for ensuring you have the legal right to use any photo you upload.

You agree not to upload, create, share, or process any content that:

• Contains nudity, sexually explicit material, or pornographic content;
• Depicts or promotes violence, graphic injury, or harm to any person or animal;
• Contains racist, hateful, discriminatory, or abusive imagery or promotes hate speech;
• Infringes on any intellectual property rights, including copyrights, trademarks, or publicity rights;
• Violates any applicable local, state, national, or international law or regulation;
• Depicts minors in any inappropriate, exploitative, or harmful context; or
• Contains malicious code, viruses, or any content designed to disrupt or damage the Service.

You also agree not to attempt to reverse engineer, decompile, disassemble, or otherwise interfere with the Service or the infrastructure that supports it. We reserve the right to remove any content and terminate accounts that violate this policy, without notice or refund.

4. Credits, payments, and taxes

RePhoto operates on a credit system. Free accounts receive promotional credits on signup. Additional credits can be purchased through Paddle, our merchant of record. Prices, applicable taxes, currency, and billing frequency are displayed during checkout before you finalize the transaction. You authorize Paddle to process payments on our behalf.

Purchased credits remain valid for 12 months from the transaction date. Any unused credits expire automatically after that period and cannot be reinstated. Credits have no cash value, are non-transferable, and cannot be exchanged for money unless required by law. You are responsible for any taxes that apply to your purchases.

5. Refunds

Refund requests are handled according to our Refund Policy, available at /legal/refund-policy. If Paddle issues a refund, any associated credits will be removed from your account.

6. Intellectual property

All content, features, and functionality of the Service—including software, text, images, illustrations, logos, and designs—are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.

7. Data privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to our data practices as described there.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. Except as required by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that restored files will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the amounts you paid for credits in the twelve months preceding the event giving rise to the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if continued service poses risk to other users, our infrastructure, or Paddle’s compliance requirements. Upon termination, any unused credits may be forfeited.

11. Governing law

These Terms are governed by the laws of Argentina, without regard to its conflict of law rules. The courts located in Buenos Aires, Argentina will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.
